Synopsis: India saw over 83,000 AI patent filings between 2019 and 2025, but gaps in IP protection and regulation continue to challenge MSMEs, a TCS–CII report said.

Mumbai: Artificial intelligence patent filings in India have seen a sharp acceleration since 2019, with as many as 83,059 AI-related patents filed between 2019 and 2025, compared with just 3,931 during 2010–18, according to a joint report by Tata Consultancy Services (TCS) and the Confederation of Indian Industry (CII).

Released at the CII Global Summit on Technology, R&D and IP in New Delhi, the report—Artificial Intelligence and Intellectual Property: Navigating Opportunities and Challenges in a Transformative Era—highlights how rapid advances in AI and GenAI are reshaping the intellectual property landscape across sectors such as healthcare, finance, manufacturing and retail.

The study, based on inputs from 73 global experts, notes that while government initiatives and public–private partnerships are accelerating AI adoption in India, especially among micro, small and medium enterprises (MSMEs), IP protection remains a key challenge. Issues such as technical complexity, unclear ownership of AI-generated inventions and evolving regulatory frameworks continue to hinder wider participation by smaller firms.

The report also flags emerging governance risks, including bias, misinformation, deepfakes and challenges linked to autonomous and agentic AI systems, underlining the need for stronger legal frameworks, ethical standards and robust IP risk-mitigation strategies at the enterprise level.

TCS said the findings are aimed at helping enterprises, policymakers and startups balance innovation with regulatory foresight and capacity building, as India positions itself as a global AI and IP powerhouse in line with its long-term economic ambitions.
