The Ministry of Electronics & Information Technology has amended Rule 3(1)(d) of the IT Rules, 2021, ensuring that any direction to remove unlawful content must now come from senior officials — at least Joint Secretary level — with monthly reviews to ensure proportionality.
These rules seek to improve clarity, reduce arbitrary takedowns, and protect both users’ rights and government accountability. For intermediaries, compliance and governance systems must be strengthened to maintain safe-harbour protection under the IT Act.
The move reflects India’s shift toward structured digital governance — promoting accountability while ensuring an open, trusted online environment for innovation and business.
